Superior National Forest: Prospecting May Be Permitted

The Associated Press in Minneapolis reported that prospecting may be permitted in Superior National Forest in the wake of a recent environment impact statement.   The U.S. Forest Service said Tuesday, May 28, 2012 that it has completed a final environmental impact statement on the effects of prospecting for copper, nickel, platinum and related minerals in the Superior National Forest of northeastern Minnesota, clearing the way for a federal agency to issue 29 drilling permits near Ely.

If the Bureau of Land Management issues the permits, the prospecting would have to abide by the protections specified in the final environmental impact statement that was posted online Tuesday, the Forest Service said.

New Rules for Entry Into Canada Change Little


In reviewing the comments from sportsman on my website (http://www.sportsmanlawyers.com)  I have heard it all.  

There have been comments from thankful folks that can cross the border to hunt the Canadian Rockies due to an application for rehabilitation, to sad stories of honeymooners staying on the US side of Niagra falls because of a prior misdemeanor.  

However, there has been recent talk in the papers that getting  into Canada is now much easier (http://www.startribune.com/sports/outdoors/152115605.html)  The Canadian government has stated that they are easing entrance restrictions.  

This may not be the case.

I just received this note on my website:

On  Monday evening (May 21, 2012) my girlfriend and I were both denied entry to Canada at Vancouver airport. The reasons for both of us being denied entry were said to be because of old criminal convictions.

Unfortunately, access is still at the desecration of the border patrol.  At Chaudhary  Law Office, PLLC we continue to urge you to clear up any prior legal entanglements before heading north for business or pleasure.

Satveer Chaudhary quoted in a Star Tribune Article

Chaudhary Law Office founder, attorney Satveer Chaudhary, was quoted yesterday, May 19th, 2012 in a Minneapolis Star Tribune articel about travel to Canada.  Earlier in the year Candadian authorities have stated that border patrols will have the option to allow those with minor infractions on their criminal records, that occurred more than 5 years ago, to apply for a one-time resident permit for entry into Canada.   The entry, however, is completely at the discretion of the border crossing officer.

The article states:

But meanwhile, those with multiple misdemeanor convictions or more serious offenses still have difficult hurdles to clear if they want to enter Canada.

"I continue to have a steady stream of people [seeking help]," said Satveer Chaudhary, a Fridley attorney and former state legislator. People can seek "criminal rehabilitation" status by filling out numerous forms and getting an FBI background check, which can take eight weeks to receive. Fingerprints also are required.

That process is lengthy, but if accepted, a person can enter Canada freely. "People make mistakes," Chaudhary said. "Most of those mistakes shouldn't be a lifelong yoke around your neck if you want to hunt and fish." His advice: Plan ahead. It can cost several hundred to several thousand dollars, depending on whether a person hires an attorney or not, to acquire criminal rehabilitation status.

Ultimately, those with criminal convictions will have to decide if they're willing to pay the money and spend the time jumping through those bureaucratic hoops, Chaudhary said. "I had that conversation with a fellow last week. He said, 'Well, I don't need to go to Canada that bad.'"

On behalf of the 23,000 members of The Nature Conservancy, I would like to personally thank Senator Satveer Chaudhary for his leadership in the 2010 Legislative Session.
This was a very tough budget year, and the new Clean Water, Land and Legacy funds were the only bright spot in an otherwise bleak financial situation. It was a huge challenge to ensure those funds were appropriated in a manner that would keep faith with Minnesota voters that overwhelmingly approved the measure in 2008.
Given this backdrop, Senator Chaudhary was instrumental in shepherding an inspiring package of conservation projects through the legislative process. These projects will truly leave a legacy for all Minnesotans that preserve our lakes, rivers, forests, prairies and wetlands. These natural resources are the foundation of Minnesota’s wealth and quality of life, and investing in them – even in tough economic times – is essential to our way of life.

But it was only a minor offense? Canada's rules of entry

So are only felons denied entry at the border into Canada?  Not hardly!  Even more minor offense can keep you from your honeymoon, business trip or hunting adventure in our neighbor to the north.  

Canada defines "inadmissible," as taken directly from the Canadian Embassy's official website:

"Members of Inadmissible Classes include those who have been convicted of MINOR OFFENSES (including shoplifting, theft, assault, dangerous driving, unauthorized possession of a firearm, possession of illegal substances, etc.), or of INDICTABLE CRIMINAL OFFENSES (including assault with a deadly weapon, manslaughter, etc.). As well, those who have been convicted of DRIVING WHILE INTOXICATED (DWI) are considered Members of an Inadmissible Class. Driving while under the influence of alcohol is regarded as an extremely serious offense in Canada.


So regardless of how minor you feel the offense was, it may be sufficient in the eyes of the Canadian Border Patrol to send you packing back home.  Check it out before you go!

Have a DUI and Planning a Trip to Canada? Here is Something You Should Know


 If you have plans for hunting, fishing or vacationing in Canada, there are certain things you can’t forget in preparation for the big event. Pack your hunting gear. Don’t forget a camera. When fishing, be sure to bring a water proof jacket, and plenty of Dare Devils. But, you may be surprised to know, that you also must make sure you remember any driving mishaps, or teenage pranks that involved the police. Because if you’re traveling to our neighbor to the North, you may be stopped at the border for legal entanglements that have been minimized or have even been long forgotten.
     
That’s exactly what happened shortly before 9/11 to Steve, a Cleveland native, traveling with buddies to a softball tournament in Manitoba. Questioned at the Canada/ North Dakota border, Steve revealed a long ago DWI to Canadian authorities. Immigration officials then questioned him for three hours regarding the offense, and finally denied Steve’s entrance. He lost the time driving to Canada, wasted the deposit for his Canadian hotel and missed out on the wonderful male bonding experience. So while the rest of his team played softball in Winnipeg, Steve spent the weekend alone in downtown Pembina, North Dakota, exploring the local gas station and church museum, until his team picked him up days later on their way home. A wasted opportunity, because Steve failed to realize that due to a long ago conviction, he needed to legally prepare or be left behind at the border.
     
Like Steve, anyone with a criminal conviction will require unique legal assistance before travelling to Canada for any reason. Most Americans take entry into Canada for granted, and often consider it simply a borderless extension of the United States where people say “Eh.” The reality is strikingly different. So, before you book that work meeting, vacation with the kids, honeymoon or elk-hunting trip, it’s really important to consider the issues relating to any prior legal entanglements and that Canadian border. These issues include who can enter the country, who can be excluded, how you can overcome exclusion, and how someone who is ineligible can nonetheless seek entry to Canada.

Taking the Kids Camping in Canada? Some important Tips

Congratulations!  You've finally set up that hunting (fishing) trip to Canada with your teenager!  The bags are packed, the iPhone is put away, and you've mapped out the travel schedule.  You are all set to share your love of the great outdoors with your child.  Or are you?


There are certain things you need to know before you go.  The Canadian Border Patrol watches for missing or abducted children and may ask detailed questions about the children who are traveling with you.  Make sure you're prepared before you go!  Here are a few tips:

  • If you're traveling with kids, you should carry identification for each child. 
  • In the case of infants who have not yet been issued birth certificates, an original baptismal or hospital certificate that indicates the country of birth is sufficient.
  • If you are travelling with children, you should carry identification for each child. 
  • Divorced parents who share custody of their children should carry copies of the legal custody documents.  
  • Travellers under the age of 18 and unaccompanied by a parent need a letter of permission to travel in Canada from a parent or guardian. Have it notarized.  It should state where the minor is going, how long they plan to travel, where they're staying and when they plan to return.   Include all the parents' contact info, address and phone numbers.
  • Children traveling with one parent, grandparents, or other guardians should carry proof of custody and/or notarized letters from the non-accompanying parent(s) authorizing travel. This is in addition to proof of the child’s citizenship. This letter should contain contact telephone numbers for the other parent or legal guardian not present. 
  • Travelers without such documentation may experience delays at the port of entry.  
  • If you are traveling as part of a group of vehicles, be sure that you are in the same vehicle as your child/children when you arrive at the border.

Yesterday, on the day of the Minnesota Fishing Opener, I didn’t get to go fishing. I did, however, take my 5 year old son fishing.
Minnesota State Senator Satveer Chaudhary of Minnesota District 50 hosted a youth fishing event on Lake Johanna with the Minnesota BASS Federation. Any kid that showed up was taken on a fancy bass boat and provided with a life jacket, a fishing pole, and bait, free of charge.
I went out to the event with my son and was amazed at how many boats were on shore waiting for kids when we got there. One of the members of the BASS Federation greeted us and volunteered his boat because he brought a more traditional fishing boat with higher sides than a bass boat. He thought my son would be more comfortable on it. We got on our life jackets and climbed aboard.
On the way out, our guide was very conscientious and made sure not to go to fast for my son. He used his fish finder to show us that we were headed to a hump in the middle of the lake. My son was very interested in how the fish finder worked. In fact, during our actual fishing, he was more interested in watching the electronics than the act of fishing at times.
When we got to our destination, our guide rigged up a nightcrawler on a jighead for my son. He put a Gulp leech on a spinning reel for me, and set up a crank bait for himself. I only really cast out once or twice before helping my son and the our guide soon put a worm on a jig with a skirt under a slip bobber to try to get a fish on the line for him, too. I was jigging with my son’s worm and felt a tick-tick-tick, but couldn’t set the hook fast enough. I reeled in and our worm was gone. We used a trolling motor to go back and forth over the hump a bunch of times and our guide got a few hits, but nothing he could keep hooked. They were just biting lite. My son’s line didn’t get any more action.
Our guide’s com padres were all hitting the shore with older kids and we only heard hooting and hollering once. Our guide was smart to use a bobber and jigging for my son. You can’t really cast with someone so young. Even though we didn’t catch anything, my son said he had a lot of fun. He enjoyed being out on the boat. So already at such a young age, he has the right attitude about fishing.
I was glad to hear he had a good time and I enjoyed taking him out. I also got to ask some questions of our guide and methods. I picked up a few tips and hope to put some of them to use soon.
From what I saw, all the kids were having fun. I hope Senator Chaudhary makes this an annual event. Fishing with your kids is almost always better than any day out on your own.






Going to Canada on Vacation, for Business or a Honeymoon? Read This First!

Who can be stopped at the Canadian Border?


For the past decade honeymooners, anglers, hunters, and other tourists vacationing in Canada have been rejected at the border.  Why: Increased U.S./Canada border security.



Canadian immigration law prevents anyone with a criminal history, sometimes a mere charge, from crossing their border. The length of time since the conviction, or outcome of the charge, does not always affect your inadmissibility. With preparation, however, many have successfully overcome their inadmissibility and took their dream trip.


Canadian border officials have the right to deny entry to individuals having a single DWI or other misdemeanor on their criminal records. Consequently, thousands of Americans have been snared by the increase in border security in recent years.


In March of 2012, after years of turning back Americans with drunken-driving and other misdemeanor convictions, Canadian border officials relaxed their entry restrictions. But the changes won't apply to those with multiple convictions or more serious offenses.


Can this affect me?  


Business travelers, honeymooners, hunters, anglers and tourist with more than one conviction will still be denied entry.  “I have dozens of clients either turned away or know they can't get into Canada," said attorney, Satveer Chaudhary, in a 2012 StarTribune newspaper article.  "I have a client who was going with a group of friends to Winnipeg for a softball tournament. He had a prior DWI from years before, and was denied entry. He spent the weekend at Pembina, N.D., waiting for his friends to return to pick him up.”



The 2012 Citizenship and Immigration Canada policy changes allow for a single free Temporary Resident Permit (TRP) to enter Canada for those with one minor conviction. Americans with convictions still would have to go through a "rehabilitation" process to permanently clear their record, but the TRP could prevent their rejection at the border for some criminal issues.



While many convictions can prevent entry, DWIs, Reckless Driving, Drug Possession, Theft and Assault are the most commonly seen.  Even dismissal of a charge can prevent entry to Canada. A simple matter here may be a big deal in Canada, and since the Canadian  border officials can access FBI criminal history records, downplaying one’s past is dangerous.


A key unanswered question is whether the new TRP permit will give an American just one entry into Canada, or whether it would be good for a longer period of time.


Can’t I do this myself?                


The Canada Border Services Agency (CBSA) has wide discretion in allowing those with prior offenses to enter Canada.



We don’t necessarily defend Canadian policy and, indeed, the U.S. has similar rules of entry. But, the goal is to offer successful solutions to those affected.  The processes take time and paperwork beforehand, but can ensure your trip proceeds without delay or embarrassment if turned away at the border.



You can apply for “rehabilitation” if an offense was 5 or 10 years from the completion of your sentence, and can show you are now law abiding. Still, immigration rules are fraught with red tape. Any incomplete documentation can easily result in rejection or delay. Required FBI records complaints, orders, sentences, restitution, and probationary documents can be hard to track down. So sometimes it helps to “turf it off” to those with experience in these matters.
