But it was only a minor offense? Canada's rules of entry

So are only felons denied entry at the border into Canada?  Not hardly!  Even more minor offense can keep you from your honeymoon, business trip or hunting adventure in our neighbor to the north.  

Canada defines "inadmissible," as taken directly from the Canadian Embassy's official website:

"Members of Inadmissible Classes include those who have been convicted of MINOR OFFENSES (including shoplifting, theft, assault, dangerous driving, unauthorized possession of a firearm, possession of illegal substances, etc.), or of INDICTABLE CRIMINAL OFFENSES (including assault with a deadly weapon, manslaughter, etc.). As well, those who have been convicted of DRIVING WHILE INTOXICATED (DWI) are considered Members of an Inadmissible Class. Driving while under the influence of alcohol is regarded as an extremely serious offense in Canada.


So regardless of how minor you feel the offense was, it may be sufficient in the eyes of the Canadian Border Patrol to send you packing back home.  Check it out before you go!

Winter 2011 State and Federal Updates

A great update from my friend Don MacMillan about important things on the Minnesota and US political landscape for hunters!  Enjoy!


Federal and state Issues

     This is the year of another new “Farm Bill” for the Congress.  There are some changes on the horizon that
will have a negative impact on our activities as well as conservation, in general.   one example is the successful “walk in” program that we just began this past year in Minnesota with federal matching funds.  some 10,000 acres of private farm land was enrolled in Minnesota which provided a place to hunt and fish for many Minnesota hunters and fishermen.  Congress has recently removed these matching dollars from the
appropriations process to help reduce the deficit.  This is false economy due to the fact that more hunters in the field equates to more revenues for both the federal and state government.

     At this point, this program is in jeopardy here in Minnesota because our state budget is an issue also so it is unlikely that there will be money available here.   This has been a great program that provides much needed access for those of us who hunt and fish in Minnesota.   As this is an election year and Congress is in a gridlock so don’t expect much in the line of significant legislation to come out of the Congress in 2012.  This year is all about the November presidential Election and the changes that will occur due to redistricting coming out in the middle of February.  one issue that may be resolved by the Congress is the wolf issue in Minnesota.  Because of the way the Endangered species Act is written it is relatively easy for anti-hunting groups like Hsus and to an extent, Sierra Club, to stop turning over management of wolves to the Minnesota DNR and wolf hunting in this state.   These organizations have the ability to keep this issue in the federal courts forever.  our Minnesota Congressional Delegation, with a couple of exceptions, are doing their best to pass a bill in the Congress that would end this stalemate and take the issue out of the courts.  That is the only way that this population of wolves can be managed from a scientific standpoint in this country.  Encourage your Congressman and our two Minnesota senators, Amy Klobuchar and Al Franken, to help with this issue.

State Issues
The Minnesota Legislature has a shorter session this year and does not meet until later in January of 2012.  There continues to be many challenges due to a shortage of money in all areas.   The Department of Natural Resources, which regulates most of our hunting and fishing activities, is not exempt from budget cuts which will have to happen to help eliminate large deficits.   Many of us have been asking the Minnesota Legislature to make some modest increases in our hunting and fishing license fees for both residents and nonresidents, but the Minnesota Legislature is reluctant to increase any fees in a bad economy.  However, it has been over 11 years since any of these fees have been increased so an exception should probably be made.   If you have an opportunity, you may wish to discuss this issue with your elected representative House Member or Senator.   We continue to direct a significant amount of resources available through the sales tax increase dedicated by our constitution to improving habitat for our outdoor activities.  This will be the third year of this program
and the money continues to go toward the projects that sportsmen and women in Minnesota had in mind  when this amendment was passed in 2008.  However, this has not been automatic by any means.  It takes a constant presence at the Capitol to make sure that our elected officials do not divert this money to other causes no matter how noble they may be.  This is being accomplished by the groups who belong to the Minnesota outdoor Heritage Alliance (MOHA) including the Minnesota Chapter of SCI.   We continue to educate the legislature and the public to make sure that all of the funds collected go toward projects that enhance and grow habitat for hunting, fishing and trapping in Minnesota.   Don’t forget to thank your legislative representatives for helping make this happen, and if they don’t believe in this program, set them
straight.

Welcome to Pembina, ND: A Canada Border Crossing Tale


Shortly before 9/11 Steve, a Cleveland native, was traveling with buddies to a softball tournament in Manitoba. When questioned at the Canada/ North Dakota border, Steve revealed a long ago, almost forgotten,  DWI to Canadian authorities.  Unfortunately for Steve, that really changed the outcome of his planned trip to Canada.  
After sharing the information with Canadian authorities, he was marked as inadmissible for entrance. For the next three hours, Immigration officials questioned Steve regarding the offense, and finally denied his entrance into the country.  His team mates proceeded to the tournament without him.  Steve missed out on so much by forgetting about the Canadian border crossing regulations.  He lost the time and gas money driving to Canada, wasted the deposit for his Canadian hotel and missed out on the wonderful male bonding experience of being with his buddies. 
So while the rest of his team played softball in Winnipeg, Steve spent the weekend alone in downtown Pembina, North Dakota, exploring the local gas station and church museum, until his team picked him up days later on their way home.  A wasted opportunity, because Steve failed to realize that due to a long ago conviction, he needed to legally prepare or be left behind at the border.

So, if you have any business, personal or recreational trip to Canada planned, be prepared and consult with a lawyer to answer your questions to see if you may be at risk for a weekend tour of Pembina, North Dakota.

Applying for Criminal Rehabilitation in Canada

As mentioned earlier, you may wish to travel to Canada, but have a recent issue on your legal record.  You may also apply for individual criminal rehabilitation, 5 years following the original conviction.  You can apply for “criminal rehabilitation” by submitting the following:
  1. An application form IMM 1444E
  2. A copy of your passport data pages
  3. An FBI police certificate
  4. A state police certificate
  5. A passport size photograph
  6. Copies of court documents indicating the charge, section of law violated, the verdict, and sentencing
  7. Proof of completed sentences, paid fines, court costs, ordered treatments, etc.
  8. Three letters of reference from responsible citizens.
  9. Copies of the text of the law describing the offense.
  10. Detailed explanation of the circumstances surrounding the offense
  11. A non-refundable processing fee of $200 USD
Individuals may apply for a temporary resident permit to enter Canada prior to rehabilitation.  However, this is up to the passport control officer's discretion and requires a $200 fee.  A temporary resident permit is meant to allow entry for exceptional circumstances only.  These reasons would include national interest or strong humanitarian/compassionate grounds.
It’s important to note that if you are traveling through Canada’s International Airports or arriving on an international flight from the USA, you will be required to clear passport control, even if you’re continuing to a connecting international flight with a destination outside of Canada.  If they find the DWI / DUI on your record you may be sent to immigrations screening and a potentially along wait delay.

Canada Traveler Information: DWI or DUI Driving or Other Misdemeanor Convictions


Are you considering taking a trip to Canada? Looking forward to a honeymoon in British Columbia?  Hunting elk in Alberta? Visiting your cousin in Toronto?  Well, if you have been convicted of DWI or DUI, or many other misdemeanor convictions within the last ten years, make sure you take care of the issue before you try to cross the border.  Any type of impaired driving offense is considered the equivalent to the Canadian Criminal Code offense of impaired driving, and Canadian law considers impaired driving (driving with a blood alcohol concentration above .08) to be a serious offense. In fact even a first offense conviction of impaired driving results in a criminal record, a minimum $1000 fine, and a driving prohibition for a minimum of one year.

Routine screening upon entry into Canada includes the question, “Have you ever been convicted of a crime?”  If you have been convicted of impaired driving, or other offenses you may feel are minor, you may be denied entrance.  More importantly, if you're entering from the United States, as part of post-911 security measures, border agents may already have access to criminal records. If you lie or forget about a conviction, you may be barred from entry into Canada for many years.  

A person with a conviction may be deemed rehabilitated and be eligible for entry after a certain period of time,   depending on the offense.  This period may be as short as 5 years or as long as 10 years. 

You may also apply for individual criminal rehabilitation, 5 years following the original conviction.
